A non-refundable down payment of 10% of the accepted bid will serve as earnest money and will be due upon signing a real estate contract. The successful bidder will enter a binding contract with the balance due in certified funds at closing with possession on or before January 8, 2020. There will be NO financing contingency.

2019 TAXES: $1656.70 Taxable acres: 107.68 Seller will pay 2019 taxes and prior years. Buyer will be responsible for 2020 taxes.

Property was leased for the 2019 crop year, but will be available for possession at the time of closing. Seller will grant permission for Buyer to apply fertilizer/chemical during the escrow period if so desired.

Mineral and water rights will transfer to the Buyer. Any FSA government payments forthcoming from the crop year 2019 or previous years will be retained by the Seller. There is currently NO lease to a wind power company. No staked survey will be performed by the Seller. If Lender requires a survey, the Buyer will be responsible for the cost.

The property is subject to easements by Nemaha Co. RWD #3 and the Kansas Power & Light Co. its successors and assigns.

The property lies within the confines of the Nemaha Brown Joint Watershed Dist. #7 and within the Pesticide Management Area and is restricted as to the use of atrazine.

Nemaha County Abstract & Title Co. will be the escrow and closing agent. Buyer and Seller will divide equally the cost of owner's policy of title insurance and closing costs. Buyer will be responsible for all Lender's charges for obtaining a loan if necessary. FINANCING must be in order before bidding on the property.

Property sells subject to Sellers confirmation.

Announcements made on auction day take precedence over all printed material.
