TERMS AND CONDITIONS

A non-refundable down payment of 10% of the accepted bid will serve as earnest money and will be due upon signing a real estate contract. The successful bidder will enter a binding contract with the Seller upon completion of the auction. The balance will be due in certified funds at closing with possession on or before April 21, 2021. There will be NO financing contingency.

This farm has a tenant for the 2021 crop year for the tillable acres so Buyer will get possession on the tillable acres after fall harvest is completed. The Buyer will receive the entire year lease payment as a credit at closing. The pasture has no lease for 2021, so the Buyer will receive possession on the pasture at closing.

2020 taxes: $2268.04. Seller will be responsible for 2020 taxes, Buyer will be responsible for the 2021 year taxes.

Mineral rights will transfer to the Buyer. Any FSA government payments forthcoming from the crop year 2021 or previous years will be retained by the Seller/Tenant. No staked survey will be performed by the Seller. If Lender requires a survey, the Buyer will be responsible for the cost.

Nemaha County Abstract & Title Co. will be the escrow and closing agent. Buyer and Seller will divide equally the cost of owner's policy of title insurance and closing cost. Buyer will be responsible for all Lender's charges for obtaining a loan if necessary. FINANCING must be in order before bidding.
